Reem Mall provides website features and other products and services to you when you visit or shop at Reemmall.ae (the “Site“), use Reem Mall products or services, use Reem Mall applications for mobile, or use software provided by Reem Mall in connection with any of the foregoing (the “Services“). Reem Mall provides the Services and sells products to you subject to the conditions set out herein. Reemmall.ae is the trading name for Al Farwaniya Property Developments LLC (the “Company”), the legal owner of Reem Mall.

Please read these Terms and Conditions carefully before using this Site and the Services. These Terms and Conditions shall constitute a legally binding agreement between you as the user of the Site (referred as “user”, “you”, “your” hereinafter) and the Company (referred to as “we”, “us”, “our” hereinafter).

If any dispute, claim, difference or controversy arising out of, relating to or having any connection with these conditions, including as it may relate in any way to your use of any Services, or to any products or services sold or distributed by the Company or through Reemmall.ae, or the existence, validity, interpretation, performance, breach or termination and/or any dispute relating to any non-contractual obligations arising out of or in connection with them shall be settled by the exclusive jurisdiction of the courts of the Emirate of Abu Dhabi, United Arab Emirates.

  1. Alterations to Service or Amendments to the Conditions of Use

You will be subject to the terms and conditions, policies and Conditions of Use in force at the time that you use the Services. CONDITIONS OF SALE

Please read these conditions carefully before using the Services and placing an order with the Company. By placing an order, you signify your agreement to be bound by these conditions.

  1. Online Marketplace

The Company shall offer you an online marketplace, an e-commerce Site, whereby you are connected with vendors (the “Vendor(s)”).

Transactions made using our Site may allow us and other Vendors to list and sell products, as Vendors may operate stores, provide services, or sell product lines on our Site.

The information and materials displayed and contained on this Site are subject to change and availability. Some products or merchandise may not be always accessible or available due to demographic characteristics or to a stockout, you shall understand that we will always inform you of the unavailability of any product.

By using our Site, you may be asked to create or log-in to your own account that shall have a valid payment method associated with it. You shall claim full responsibility for maintaining the confidentiality of your account information and for the activities that occur under your account.

Unless expressly indicated otherwise, we are not the manufacturers of the products sold on this Site. Whilst we do our utmost to ensure the accuracy of the content and products displayed on our Site, as an online marketplace, we are not liable or responsible in any way for examining or evaluating the products listed on our Site as actual product packaging and the materials it may contain are subject to change.

Furthermore, we do not assume any responsibility or liability for the actions, product, and content, misstatements of any Vendor displayed on our Site and their respective Site. While your reliance upon any information provided on our Site shall be at your own risk, we shall recommend you not to rely solely on the information or descriptions displayed on the Site and to always read labels, warning and directions provided with any product before its use.

While the Company helps facilitate transactions that are carried out on the Site, it is neither the buyer nor the seller of the Vendor’s items. As a result, the contract formed at the completion of a sale for these third-party products is solely between you and the Vendors. We shall not be a party to this contract nor assume any responsibility arising out of or in connection with it. Any Vendor is responsible for the sale of the products and for dealing with any claims or issues arising out of or in connection with the contract between the buyer and seller.

The Company charges an additional fee for the use of our Services and for the cost of transporting and delivering your goods (the “Fees”). We may change our Fees from time to time for temporary promotions or for any required reason by posting the changes on the Site, without any notice in advance.

  1. Orders

When you place an order with us (the “Order”), we will confirm your order by sending you a confirmation email containing the Order receipt. Where applicable, Orders will include delivery fees and any applicable tax (e.g., goods and services tax, value-added tax, etc.).

Some of our Services require a minimum order value (the “MOV”) before an Order can be placed and delivered to you. Where an applicable Order fails to meet the MOV, you will have the option of paying the difference to meet the MOV or to add more goods or products to your Order. Please note that your Order may be subject to additional terms and conditions provided by the Vendor.

When placing an Order on our Site, you shall follow the onscreen instructions provided. You may be required to provide additional details for us to complete your Order, and you shall review and confirm that all the information you provide, including the amounts, delivery details, personal details, payment information, and voucher codes (if applicable) is true, accurate and complete before you place your Order.

An Order is successfully placed when you receive an email confirmation containing your Order receipt from us.

If you wish to cancel your Order after it has been placed, contact us immediately via our Customer Services. You have the right only to cancel your Order provided your Order has yet to be accepted or processed. In the event you Order has been cancelled by the Company as per the terms herein, you shall be entitled for a refund. Should you still decide to cancel your Order after it has been accepted or processed, you understand that no refunds (whether in whole or in part) will be issued to you and you forfeit the delivery of your cancelled Order. Please understand that we may require you to provide additional information prior to processing any refund.

Further, the Company reserves the right to cancel any Order and/or suspend, deactivate or terminate your account in its sole discretion, if it reasonably suspects or detects fraudulent behavior or activity associated with your account and/or with your Order.

  1. Payments and Prices

Prices quoted on the Site shall be displayed in the national currency of the United Arab Emirates, and subject to applicable tax. Prices on the Site may vary from the prices offered by our Vendors, and you accept that offers offered by our Vendors. The prices displayed on our Site may include or exclude VAT or such equivalent tax.

By placing an Order on our Site, you agree to all amounts, additional charges and the final total amount, which is displayed to you via a breakdown of fees.

You can choose to pay for an Order using any of the different payment methods offered on the Site including:

  1. Our payment partners: Visa, Mastercard, American Express, Google Pay, PayPal, Apple Pay.
  2. Cash-on-Delivery; or
  • Any other payment method we may offer from time to time.
  1. Delivery of Goods

As we are always seeking to bestow you with the best shopping experience, we shall provide you with professional delivery services in the United Arab Emirates.

Delivery of your goods shall be handled by a third-party delivery courier to the address information you provide us with.

An estimated delivery time will be provided to you via an email confirmation. However, you agree that due to major unforeseeable operational disruptions owing to without limitation to shortage of raw materials, workers, strikes, traffic, lockdowns, delay, official control measures and events of force majeure in delivery or non-delivery by the delivery carrier may occur, and we shall not bear any responsibility or liability thereof. As such events are relevant to our ability to deliver the goods through our delivery carrier, delivery times shall vary accordingly.

You acknowledge that the transportation of products shall occur at your sole expense, and we shall choose the means and route of transportation at our sole discretion. At the time of handling the goods to the delivery carrier, all risks shall pass to your end. The Company shall not be liable for accidental destruction of, loss of or damage to the products.

Delivery fees are chargeable on every Order unless you have a valid promotional or discount voucher and apply it at checkout or unless stated otherwise.

You understand that we may refuse delivery if you are unable to prove you are of legal age, and/or we may refuse delivery to any persons for any reason whatsoever.

In the event where we attempt to deliver an Order, but we are unable to do so due to the reasons caused by your end, or if you are uncontactable, or if you fail to receive the Order within ten (10) minutes from the time the Order arrives at your delivery address, you understand that we reserve the right to cancel the Order without refund or remedy to you.

If you encounter any issues with your Order (e.g., wrong order, defective order, or missing items), please contact our Customer Services immediately, and you shall acknowledge that in some cases, we may request for photographic proof and/or additional information to properly investigate the issue with your Order to take the right measures accordingly.

  1. Discounts and Promotions and Vouchers

We may run occasionally marketing and promotional campaigns where voucher codes, discounts, promotions may be offered to be used on our Site. Promotional offers or vouchers are subject to validity periods, periods, and in some they may only be used once.

When used in conjunction with other promotional means or offers, vouchers may not be valid, and unless otherwise stated, discounts and promotions and vouchers can only be used on our Site.

Vouchers cannot be replaced with cash, and we shall reserve the right to void, discontinue or reject the use of any Voucher without prior notice when deemed reasonably fit.

We will not be responsible for (i) losses that were not caused by any breach on our part, or (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both you and us when the contract for the sale of products by us to you was formed.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your right to have the products sent to you within a reasonable time. If the delay occurs before the products are shipped, you may cancel your order at any time prior to shipping.
